Terms of Service
Draft · last edited November 7, 2026
These terms are an agreement between you (or the business you represent) and We Build Apps LLC ("we", "us") for your use of We Do Marketing. By creating an account or using the service, you agree to them. If you use We Do Marketing for a business, you confirm you're authorized to accept these terms for it.
1. The service
We Do Marketing helps you plan, create, launch and measure marketing campaigns. Features differ by plan, as described on our pricing page. We may improve, change or retire features over time; if a change materially reduces what you've paid for, we'll tell you in advance.
2. Your account
- Keep your sign-in details secure. You're responsible for activity under your account.
- Give us accurate information, and keep it up to date.
- You must be at least 16 and able to form a binding contract.
3. Plans, billing and cancellation
- Paid plans renew automatically each month or year until cancelled. Payments are processed by Stripe.
- Plan limits, including what counts as a campaign package, are explained in the app and on the pricing page. Downloads and exports don't count against your plan.
- You can cancel anytime. Your plan stays active until the end of the period you've paid for. Except where the law requires, payments aren't refundable for partial periods.
- We'll give you at least 30 days' notice before a price increase takes effect for your plan.
4. Your content
You own what you bring to We Do Marketing (your brand assets, content, contacts and data) and, as between you and us, the campaign content generated for you. You give us permission to host, process and display it only as needed to provide and secure the service. You confirm you have the rights to everything you upload or ask us to read, including logos, images and website content.
5. AI-generated content
- Content generated by Cue can contain mistakes and may resemble content generated for others. Review everything before you publish.
- Our policy checks and guidance help you follow platform rules and laws, but they aren't legal advice and can't guarantee that a platform will approve your ad.
- You're responsible for the claims in your marketing being true and substantiated.
6. Acceptable use
You agree not to use We Do Marketing to:
- break the law or any platform's terms, including advertising policies;
- create fake reviews or testimonials, impersonate people or businesses, or mislead consumers;
- send email or messages without the recipient's permission, or ignore unsubscribe requests;
- discriminate in housing, employment, credit or other protected areas;
- infringe anyone's intellectual property or privacy;
- scrape, reverse engineer, overload or try to break the service or its security; or
- resell the service without our written agreement (agency client workspaces are allowed on the Agency plan).
7. Email and influencer outreach
When you send email through We Do Marketing, you're the sender. You must have permission to email your contacts and follow anti-spam laws (such as CAN-SPAM). When you work with creators, you're responsible for your agreements with them and for making sure paid or gifted content is clearly disclosed.
8. Third-party platforms
Connections to platforms such as Meta, Google, TikTok, LinkedIn, Pinterest and X are subject to their terms. We're not responsible for their decisions, outages or changes, including ad rejections or account restrictions. If a connection isn't available, you can still export and post manually.
9. Our property
The service, software, templates, playbooks, the We Do Marketing name and logo, and the Cue name belong to us or our licensors. These terms don't give you rights to them except to use the service. If you send us feedback, we may use it without obligation to you.
10. Suspension and termination
You can close your account anytime. We may suspend or close accounts that break these terms or put others at risk, with notice where reasonable. After closure, you can request an export of your content for 30 days, after which we delete it as described in our Privacy Policy.
11. Disclaimers
We work hard to keep We Do Marketing reliable and useful, but the service is provided "as is". To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee specific marketing results.
12. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You'll defend and indemnify us against third-party claims arising from your content, your campaigns or your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of North Dakota, USA, without regard to conflict-of-law rules. Courts located in North Dakota have exclusive jurisdiction, except where the law gives you the right to bring a claim where you live.
15. Changes to these terms
We'll notify you of material changes at least 30 days before they take effect. Continuing to use the service after that means you accept the updated terms.
